Terms of Use

The terms on which Viking Abstract makes this website, its forms library, its calculators and its ordering and upload tools available.

These Terms of Use ("Terms") are a binding agreement between you and Viking Abstract ("Viking Abstract", "we", "us" or "our") governing your access to and use of this website and everything on it — the forms library, the calculators, the resource articles, the glossary, the county guides, the order form, the secure upload and the client portal (together, the "Site").

Read these Terms alongside our Privacy Policy, our Security Practices and our Licensing & Underwriter Disclosures, each of which is incorporated here by reference.

1. Acceptance

By using this website you agree to these terms. If you do not agree, do not use the site.

You represent that you are at least 18 years old and legally able to enter into this agreement. If you use the Site on behalf of a law firm, brokerage, lender or other organization, you represent that you have authority to bind that organization, and "you" means both you and that organization.

These Terms govern the Site only. They do not govern the title, abstract and settlement services themselves. Those services are governed by the title order, the title commitment and its requirements and exceptions, the closing instructions, and the title insurance policy as issued. Where these Terms and any of those documents conflict as to the services, those documents control.

2. Who we are, and what this Site is

Viking Abstract is a title, abstract and settlement services company serving New York. The Site exists to let real estate professionals and consumers order title, send us documents securely, look up New York forms and county practice, estimate closing figures, and read plain-English explanations of how a New York closing works.

The Site is an informational and transactional convenience. It is not a substitute for a title search, a title commitment, a survey, a municipal search, an attorney's review, or your own due diligence.

Viking Abstract is a title, abstract and settlement services company. It does not practice law. Nothing on this website — including the forms library, the calculators, the resource articles and the glossary — is legal, tax or financial advice. Using this site, submitting a form, or contacting us does not create an attorney-client relationship. Consult a qualified New York attorney about your transaction.

Nothing on the Site creates a fiduciary, agency or advisory relationship of any kind, and no communication through the Site should be treated as confidential or privileged for that purpose.

4. No commitment to insure

Submitting a title order or receiving an estimate does not obligate any underwriter to issue a policy, and is not a commitment to insure. Coverage is issued only under a policy on its stated terms, after the requirements in the commitment are met.

A title commitment is an offer to issue a policy subject to its stated requirements and exceptions. Nothing on the Site — an order confirmation, a status update, a calculator result or a conversation with our staff — waives, modifies or removes any requirement or exception, or expands coverage beyond the four corners of the policy as issued.

5. Home Warranty Insurance

We are not a direct insurer. The Home Warranty Insurance is provided as a service to the general public.

We get compensated for placing the Home Warranty Insurance with carriers. We can get paid up to $100.00 from the carrier.

We, us and our staff will never ask you for any money upfront for the Home Warranty Insurance.

The warranty itself is issued by the carrier and is governed by the carrier's own contract, terms, exclusions and claims process — not by these Terms and not by any title insurance policy.

6. Estimates are estimates

The calculators produce planning estimates from a configured fee schedule with a stated effective date. Actual premiums, recording fees, transfer taxes and mortgage recording tax depend on the final transaction structure, the underwriter's filed rate schedule, and the county and municipal fee schedules in effect on the date of recording. Do not rely on an estimate as a quote.

This applies to every calculating tool on the Site, including the settlement statement, the CEMA comparison, mortgage recording tax, transfer tax, the mansion tax, the Peconic Bay Community Preservation Fund transfer tax and any home value or net proceeds tool.

Rates, tax rates, exemptions, thresholds and county fees change. A stored, printed or emailed estimate reflects the schedule in effect when it was generated and is not updated afterward. Figures you enter yourself — purchase price, loan amount, payoff figures, adjustments — are used as entered and are not verified by us.

7. Forms library

Forms are provided as a professional convenience. Government forms are the property of their issuing agencies and are linked to or reproduced from official sources; always confirm you are using the current version before filing. Viking Abstract does not advise on the selection, completion or legal effect of any instrument, and is not responsible for a form that has been superseded, amended or misapplied.

Where a form is reproduced rather than linked, the "reviewed" date shown with it is the date we last checked it against the issuing agency's published version. It is not a certification that the form is current on the day you use it. Filing requirements, cover sheets, recording formats and fees differ by county and change without notice.

8. Resource articles, county guides and glossary

The resource articles, county guides and glossary are general educational material about New York practice. They are written for a general audience, they simplify, and they may become outdated as statutes, regulations, county practice and filed rates change. We have no obligation to update them.

Nothing in them is advice about your transaction, and no article should be relied on in place of a title search, a municipal search or counsel.

9. Ordering title and using the secure upload

When you submit a title order or upload documents, you represent that the information you give us is accurate and complete to the best of your knowledge, and that you have the right or authority to give us any document or personal information you send, including information about other parties to the transaction.

Submitting an order does not by itself create a binding engagement. We may decline, pause or withdraw from an order — for example where the transaction falls outside our underwriters' guidelines, where required information is not provided, or where we are unable to satisfy our legal, regulatory or anti-fraud obligations.

Do not send us Social Security numbers, dates of birth, account numbers or other sensitive personal information through the ordinary contact form. Use the secure upload.

10. Wire instructions and communications security

Viking Abstract does not send new or changed wire instructions by email, and will never ask you by email to change instructions you already hold. Treat any email, text or call that appears to change wire instructions as fraudulent until you have verified it by telephone, using a number you already have for us — not a number in the message.

You are responsible for verifying wire instructions before transferring funds. To the fullest extent permitted by law, Viking Abstract is not responsible for losses arising from instructions that did not originate with us, or from your failure to verify.

If you receive a suspicious communication that appears to come from Viking Abstract, contact us immediately using the details below.

11. Accounts and the client portal

Where the Site offers an account, you are responsible for the accuracy of your account information, for the security of your credentials, and for all activity under your account. Do not share credentials or allow another person to use your account.

Tell us immediately if you believe an account has been accessed without authorization. We may suspend or terminate an account, or access to any part of the Site, where we reasonably believe it is being misused or where a security concern requires it.

12. Acceptable use

Do not use this site to submit false information, to transmit malicious code, to attempt unauthorized access to any system or account, to scrape or bulk-download content, or for any unlawful purpose. Without limiting that, you agree not to:

  • submit information you know to be false, or impersonate any person, firm or entity;
  • transmit any virus, malware or other harmful code, or interfere with the operation, integrity or security of the Site;
  • attempt to access any account, system, data or area of the Site you are not authorized to access, or probe or test its security;
  • scrape, crawl, harvest, bulk-download, index or copy the Site's content, forms library or glossary by automated means, or use it to train a machine learning model, without our written permission;
  • resell, republish or commercially redistribute the Site's content as your own;
  • use the Site to harvest contact information, or to send unsolicited commercial messages;
  • impose an unreasonable load on our infrastructure, or circumvent any rate limit, filter or access control; or
  • use the Site for any unlawful purpose, or in violation of any applicable federal, New York or local law or regulation.

13. Intellectual property

The Site's design, text, articles, glossary, county guides, calculators, original forms and checklists, the Viking Abstract name and the Viking Abstract logo are owned by Viking Abstract or its licensors and are protected by copyright, trademark and other laws.

You may view, download and print Site content for your own use and for a transaction you are a party to or professionally engaged on. Any other reproduction, distribution, modification, framing or commercial use requires our written permission.

Government forms remain the property of their issuing agencies and are governed by those agencies' terms. Underwriter names and logos are the property of the underwriters and are used only as their approved usage policies permit.

If you believe material on the Site infringes your copyright, contact us using the details below with enough information to identify the work and the material at issue.

Links to county, state and agency resources are provided for convenience. We do not control those sites and are not responsible for their content or availability.

A link is not an endorsement. Third-party sites are governed by their own terms and privacy policies, not ours.

15. Availability and changes to the Site

We may change, suspend, add to or discontinue any part of the Site — including any form, calculator, article or tool — at any time and without notice. We do not guarantee that the Site will be available, uninterrupted, or free of errors or defects.

Where a portal or integration is unavailable, we publish a fail-safe contact route so that a live transaction is never blocked by a system outage.

16. Disclaimer of warranties

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Viking Abstract disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty as to the accuracy, currency, completeness or reliability of the content, the forms library or the calculators.

This section governs the Site. It does not limit or disclaim any obligation arising under a title insurance policy, which is governed by the policy itself.

17. Limitation of liability

To the fullest extent permitted by law, Viking Abstract is not liable for indirect, incidental, consequential or punitive damages arising from use of this website. This does not limit any obligation arising under a title insurance policy, which is governed by the policy itself.

This includes, without limitation, lost profits, lost business, delay, loss of data, and losses arising from reliance on a calculator result, a form, an article, a glossary entry or a county guide.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

18. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Viking Abstract and its officers, employees and agents from any claim, loss, liability or expense, including reasonable attorneys' fees, arising out of your breach of these Terms, your misuse of the Site, or information or documents you submit that you did not have the right or authority to submit.

19. Electronic communications and records

When you use the Site or send us information through it, you consent to receive communications from us electronically, and you agree that electronic records, confirmations and signatures satisfy any legal requirement that such a communication be in writing, to the extent permitted by applicable federal and New York law. You may withdraw that consent for future communications by contacting us, though some communications about a live transaction may need to continue in another form.

20. Changes to these Terms

We may update these Terms from time to time. The "last updated" date below reflects the most recent version, and the version in effect when you use the Site is the one that applies. Material changes will be noted on this page. Continuing to use the Site after a change means you accept the updated Terms.

21. General

If any provision of these Terms is held unenforceable, the rest remain in effect and the unenforceable provision is applied to the greatest extent permitted. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.

These Terms, together with the Privacy Policy, the Security Practices and the Licensing & Underwriter Disclosures, are the entire agreement between you and Viking Abstract concerning the Site, and supersede any prior understanding on that subject.

The section headings are for convenience and do not affect interpretation. Provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification and governing law — survive any termination of your use of the Site.

22. Governing law

These terms are governed by the laws of the State of New York, without regard to conflict of laws principles.

Any action arising out of or relating to the Site or these Terms shall be brought exclusively in the state or federal courts located in Suffolk County, New York, and you consent to the personal jurisdiction of those courts.
